6. PRODUCT WARRANTIES AND DISCLAIMERS

6.1 Limited Warranty

Trity Pipes warrants that products supplied are manufactured in accordance with applicable Indian Standards (IS) and industry specifications. This warranty extends for a period of twelve (12) months from the date of purchase, provided the product is used under normal operating conditions and in compliance with all provided specifications and installation guidelines. This warranty does not cover defects arising from misuse, improper installation, unauthorized modifications, natural wear and tear, or failure to follow maintenance recommendations.

6.2 Warranty Disclaimer

EXCEPT AS EXPRESSLY STATED IN SECTION 6.1, TRITY PIPES MAKES NO OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR TITLE. THE WEBSITE AND SERVICES ARE PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. THE COMPANY EXPRESSLY DISCLAIMS ANY WARRANTY THAT THE WEBSITE WILL OPERATE WITHOUT INTERRUPTION, ERROR-FREE, OR FULLY COMPATIBLE WITH ALL DEVICES OR CONFIGURATIONS.

7. LIMITATION OF LIABILITY

THE COMPANY'S TOTAL LIABILITY UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SPECIFIC PRODUCT OR SERVICE THAT IS THE SUBJECT OF THE CLAIM.

These limitations apply regardless of the legal theory (contract, tort, strict liability, negligence, or otherwise) upon which the claim is based and shall apply even if the Company has been advised of the possibility of such damages. Some jurisdictions do not permit the exclusion of certain damages, so these limitations may not apply in all cases.

8. PRICING, PAYMENT, AND BILLING

8.1 Pricing

All prices displayed on the Website are in Indian Rupees (INR) and are subject to change without prior notice. The Company reserves the right to correct any pricing errors that appear on the Website or in order confirmations. In the event of a pricing error in the order confirmation, the Company shall notify you, and you may choose to accept the corrected price or cancel the order.

8.2 Taxes and Applicable Charges

All prices exclude Goods and Services Tax (GST), transportation, handling, and any other applicable taxes unless explicitly stated otherwise. GST shall be calculated and charged based on the applicable rate as per Indian law and will be added to your invoice. You are responsible for paying all applicable taxes, levies, and governmental charges.

8.3 Accepted Payment Methods

The Company accepts payments through bank transfers, cheques, demand drafts, online payment gateways, and credit or debit card transactions as specified during checkout. Payment must be completed before order confirmation or delivery, unless alternate payment arrangements have been formalized in writing.

8.4 Failed Payments

If payment fails or is declined, the Company may suspend order processing and may pursue recovery through applicable legal remedies, including but not limited to legal action under the Indian Contract Act, 1872, and the Negotiable Instruments Act, 1881.

9. SHIPPING, DELIVERY, AND RISK OF LOSS

9.1 Delivery Terms

Delivery dates provided on the Website are estimates and not guaranteed commitments. The Company shall use reasonable commercial efforts to deliver orders within the stated timeframe, but delays may occur due to circumstances beyond our control, including but not limited to weather, transportation disruptions, force majeure events, or high order volume. Extended delivery periods do not constitute grounds for order cancellation unless explicitly agreed in writing.

9.2 Risk of Loss and Title

Risk of loss and title to products transfer to you upon delivery to the specified address or upon receipt by a designated third-party carrier, whichever occurs first. You are responsible for inspecting goods upon delivery and immediately reporting any damage, shortage, or discrepancies to the Company within forty-eight (48) hours of delivery.

9.3 Shipping Costs

Shipping and handling charges shall be calculated and displayed during checkout. Bulk orders may qualify for discounted or negotiated rates. Return shipping costs for defective items within warranty are borne by the Company; all other return shipping is at the buyer's expense.

10. RETURNS, REFUNDS, AND REPLACEMENTS

10.1 Return Policy

Products may be returned within thirty (30) days of delivery in unused, undamaged condition with original packaging. Returns requested after thirty days shall not be accepted except in cases of defective products within the warranty period. A return authorization number (RAN) must be obtained from the Company before initiating any return. Unauthorized returns will not be accepted.

10.2 Refund Processing

Upon receipt and inspection of returned goods, refunds shall be processed within seven (7) to ten (10) business days. Refunds shall be issued in the original payment method. Refunds are net of any applicable restocking fees (if applicable), return shipping charges, and GST.

10.3 Defective Product Replacement

If a product is determined to be defective within the warranty period, the Company shall, at its option, repair or replace the product at no cost to you. Replacement products will be shipped to you immediately upon authorization, and defective products must be returned within thirty (30) days for full credit processing.

11. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Trity Pipes and its officers, directors, employees, agents, and successors from any and all claims, damages, losses, costs, and expenses (including reasonable attorney's fees) arising from or related to (i) your violation of these Terms, (ii) your infringement of any third-party intellectual property rights, (iii) your misuse of the Website or Services, (iv) any false or misleading information you provide, or (v) any claim arising from your use or misuse of purchased products.

The Website may contain hyperlinks to third-party websites and resources. These links are provided for convenience only, and the Company has no responsibility for the content, accuracy, legality, or compliance of such external sites. 14. DISPUTE RESOLUTION AND ARBITRATION

14.1 Informal Resolution

Before pursuing formal legal action, both parties agree to attempt resolution through good-faith negotiation and discussion. You may submit a written notice of dispute to info@tritypipes.com, detailing the nature of the dispute and any damages claimed. The Company shall respond within fourteen (14) days with a proposed resolution.

14.2 Arbitration

If informal resolution fails, any dispute arising under these Terms shall be resolved through binding arbitration administered by a mutually agreed-upon arbitrator in accordance with the Arbitration and Conciliation Act, 1996. The arbitration shall be conducted in English at a venue in Ghaziabad, Uttar Pradesh. Each party shall bear its own costs, and the arbitrator's decision shall be final and binding.

14.3 Consumer Protection

Notwithstanding the above, if you are a consumer as defined under the Consumer Protection Act, 2019, you retain the right to pursue claims before the appropriate Consumer Disputes Redressal Commission, and nothing in these Terms shall be construed to waive consumer protections guaranteed under Indian law.

15. PRIVACY AND DATA PROTECTION

The Courts and arbitration authorities located in Ghaziabad, Uttar Pradesh, shall have exclusive jurisdiction over any disputes arising from these Terms. Both parties irrevocably submit to the jurisdiction of these forums.

19. SEVERABILITY

If any provision of these Terms is found to be invalid, unenforceable, or contrary to applicable law by a court of competent jurisdiction, such provision shall be severed and removed, and the remaining provisions shall remain in full force and effect. The parties shall negotiate in good faith to replace the severed provision with a valid and enforceable provision that achieves the original economic and legal intent.

20. ENTIRE AGREEMENT

These Terms and Conditions, together with any policies, guidelines, or documents expressly incorporated by reference herein (including the Privacy Policy and Return Policy), constitute the entire agreement between you and Trity Pipes regarding your use of the Website and Services and supersede all prior negotiations, agreements, and understandings, whether written or oral. No modification, amendment, or waiver of any provision shall be effective unless in writing and signed by authorized representatives of both parties.
